Hotel Winterberg Resort GmbH (Guest Accommodation Contract)
The General Terms and Conditions, which you accept when you make your booking, govern the legal relationship between you and the Hotel Winterberg Resort. Please read them carefully.
1- The guest accommodation contract is concluded as soon as the room has been ordered and confirmed. The conclusion of the contract obliges the contracting parties to fulfill the contract, regardless of the duration of the contract. Option dates are binding for both contracting parties. The hotel reserves the right to rent the reserved rooms to other parties after the option dates have expired.
2- The prices quoted correspond to the rates available at the time of the invitation to tender. We reserve the right to make changes or deviations in individual travel services from the agreed content of the contract which become necessary after conclusion of the contract and which have not been brought about by us in bad faith, provided that the changes or deviations are not significant and do not affect the overall design of the booked trip.
3- Tourist tax is levied by the town of Winterberg and is not included in our prices. This is calculated and paid separately by us.
4- Invoices must always be settled on the day of departure, taking into account any advance payments. For stays of more than 5 nights, the hotel is entitled to submit interim invoices for payment at its discretion. The hotel charges advance payment for arrivals at short notice and after 9 pm. The hotel reserves the right to request advance payments for reservations; the amount and the payment deadline are listed and indicated in the reservation confirmation. If advance payments requested by the hotel are not made by the desired date (unless a date is specified 90 days prior to arrival), the hotel is immediately released from the agreements made.
5- Despite all efforts, possible complaints are unfortunately not excluded. These must be reported immediately, preferably in writing, to reception. If the problem has not been resolved to your satisfaction after a reasonable period of time, you must assert corresponding claims against the hotel for non-contractual provision of the travel service within one month of the end of the trip.
6- Reserved hotel rooms are available to the guest from 15:30 on the day of arrival until 10:30 on the day of departure. Unless a later arrival time has been expressly agreed, the hotel reserves the right to allocate unused rooms after 18:00. The service recipient is obliged to provide the hotel with a list of participants 10 days prior to arrival. The service recipient does not acquire any claim to the provision of specific hotel rooms. Should agreed rooms not be available for whatever reason, the hotel is obliged to provide an equivalent replacement, including outside the hotel. The guest may withdraw from the booked stay at any time before the start of the journey. If the guest withdraws from or amends the contract, the following cancellation conditions shall apply:
– Cancellations or changes made up to 28 days before the date of arrival are free of charge. (Different conditions for group bookings!)
– Cancellations or changes made between 27 and 14 days before the date of arrival will be charged at 30% of the price of all overnight stays.
– Cancellations or changes made between 13 and 3 days before arrival will be charged at 55% of the price of all nights.
– Cancellations or changes made up to 2 days before arrival will be charged at 80% of the price of all overnight stays.
– Cancellations or changes made late, no-shows or early departures after check-in will be charged at 100% of the price of all nights.
7- Deviating agreements or ancillary agreements such as declarations of withdrawal, rebooking and amendments must always be made in writing. This also applies to the waiver of the written form clause. Verbal collateral agreements have not been made.
8- If the trip is directly and specifically made considerably more difficult, endangered or impaired due to force majeure (natural disasters, war, civil unrest), the hotel may withdraw from the contract.
9- All guests are required to comply with the house rules in force at the Hotel Winterberg Resort. Violation of the house rules may result in expulsion from the hotel without a full or partial refund of the rental fee.
10- The place of performance and exclusive place of jurisdiction is Arnsberg.
11- Should one or more provisions of these terms and conditions be invalid, this shall not affect the validity of the other provisions. The invalid provision shall be replaced by a valid provision that comes as close as possible to it.
12- The hotel is not liable for printing errors.
